Trademark Registration in India: What the 12-18 Month Timeline Actually Looks Like

Protection starts on the filing date, not the registration date

This is the most useful thing to understand about trademarks, and the most commonly misunderstood. Once your application is filed you can use the TM symbol immediately, and your priority runs from that filing date. If someone files a similar mark a month later, you were first.

That is why filing early matters more than filing perfectly. Businesses that wait until they are 'ready' frequently find that a similar mark was filed in the meantime, and the earlier filing wins.

A search before filing is not optional

The Trade Marks Registry does not warn you that your mark conflicts with an existing one - it examines and objects afterwards, months later. A proper search across the register and across similar-sounding marks in your class, done before filing, is what prevents that.

Search should cover phonetic similarity, not just spelling. Marks that sound alike are routinely treated as conflicting even when spelled quite differently, and this catches out businesses that assumed a creative spelling made them safe.

Classes decide what you actually own

Trademarks are registered against classes of goods and services. Registering in the wrong class gives you a certificate that does not protect what you sell.

The common error is registering only the class covering your product while your actual business is a service, or vice versa. A business that both manufactures and provides services usually needs more than one class - and each class is a separate fee, so this is a decision to make deliberately rather than discover later.

The stages, and how long each really takes

The published timeline hides where the time actually goes:

An objection is normal and not a rejection. Most objections are answerable with a properly drafted written reply. What causes real damage is missing the reply deadline, after which the application is treated as abandoned.

After registration

A registered trademark is valid for ten years and is renewable indefinitely. Renewal is not automatic - a lapsed renewal can cost you a mark you spent eighteen months obtaining.

Registration also brings an ongoing responsibility to watch for infringing marks. The Registry will not police your mark for you; opposition to a conflicting later application has to come from you, within the four-month window after that application is published.
