GST Notices and Scrutiny

A notice is not an accusation. It is a question with a deadline, and how the first reply is written decides how long the rest takes.

Read the section quoted on it

GST notices come under different provisions and they are not equivalent. A scrutiny notice pointing out a discrepancy in your return is a different thing from a show cause notice proposing a demand, and they need different responses on different timelines.

The section quoted at the top tells you which you have. That determines the deadline and what a proper reply looks like.

What is the same across all of them: the deadline is real, and silence is the worst available response. An unanswered notice generally proceeds to an order against you.

How to respond well

1

Note the deadline first

Before reading anything else. It determines what is possible.

2

Understand what is actually being asked

Most notices point at a specific discrepancy - a mismatch between returns, or between your return and your supplier's.

3

Reconcile before replying

If the department is right, saying so and correcting is usually cheaper than arguing.

4

Reply with documents, not assertions

A reply that attaches the reconciliation lands differently from one that states a position.

5

Reply through the portal

In the prescribed form, so it is on record.

The honest part

Sometimes the department is right. Where a reconciliation shows tax was genuinely short-paid, paying it with interest early is usually far cheaper than contesting and losing, because penalties scale with how long it goes on.

We will tell you which situation you are in rather than defending a position that will not hold. See also our page on GST notice replies.

Common questions

Send it to us. The section quoted tells us most of what matters, and the deadline on it decides everything else.

No. Unanswered notices proceed to orders, and an order is much harder to deal with than a reply.

That may be the explanation but it is still your reply to make. The credit is yours to justify.

Send us your case

Send us the notice itself rather than a description. The section and the date on it decide what happens next.
