No. Returns remain due and late fees accrue per day per return until the registration is formally cancelled.

Yes. A final return is due after cancellation, and missing it leaves the matter open even though the registration has ended.

Can I cancel with pending returns?

Pending returns generally have to be filed before cancellation is accepted, so clearing them is part of the process.

A registration lasts ten years. Ten years is long enough that the people who filed it have often left, and nobody is watching the date.

The problem with a ten-year deadline

A trademark registration runs for ten years from the date of application and is renewable for further ten-year terms. That is generous, and it is exactly why renewals get missed.

Ten years is longer than most people stay in a job. The person who filed it has moved on, the agent who handled it may have changed, and the reminder went to an email nobody checks. The mark that the business has been building for a decade quietly lapses.

There is a window to restore a lapsed registration, with additional fees, but it is a window rather than an open door. And a lapsed mark is vulnerable in the meantime.

What to do about it

Find your renewal date now and put it in the same place as your other statutory deadlines, not in a folder.
Keep the registration number and certificate somewhere findable. This is the thing businesses lose.
Make sure the contact details on the record are current, so notices reach the business rather than a former agent.
Renew before expiry rather than relying on the restoration window and its extra fees.
Check your other marks at the same time. Businesses that registered several often renewed some and forgot others.

If it has already lapsed

Restoration is possible within the prescribed period on payment of the additional fee. Beyond that, the mark can be lost and would need a fresh application — which means a new filing date, and exposure to anything filed in the meantime.
